2.3. By placing an order or accessing deliverables, you accept these Service Terms. If you do not agree, please do not order.

3. Service Scope

3.1. We provide submission-ready landscape designs and drawings for local HOA, city, or permit-office approval, and related deliverables as described in your quote, for building and renovation projects across the United States.

3.2. Default deliverables: Digital drawings (PDF format). CAD formats (e.g., DWG, Land F/X, VIP3D) are available on request.

3.3. Submission-ready focus. We tailor drawings for HOA, city or permit-office submissions based on your local requirements. Approval isn't guaranteed, but we do everything in our power to follow the rules and provide everything you need to gain approval for your project. This is our strength.

3.4. Not a code certification. Our drawings support planning and visualization. Unless we explicitly agree otherwise in writing, they are not engineering, architectural, irrigation, structural, surveying, or legal documents. If a licensed professional review/stamp is needed, our drawings can be used for that review and then submitted for permit/approval.

4. Service Rates & Pricing

4.1. We price work by custom quote, reflecting project size, complexity, and the level of expertise required.

4.2. The price in your quote or at checkout is the total price including applicable taxes/fees, unless stated otherwise.

4.3. Rush work. If we accept a deadline under 5 working days (from the moment we receive all required inputs), a rush fee may apply.

4.4. Any sample price ranges shown on our website are illustrative only; your written quote controls costs.

5. Price Updates

5.1. We may update prices periodically. Updates apply only to future orders and do not change the price of an order already in progress.

6. Ordering & Contract Formation

8.3. We may share drafts and staged iterations for feedback.

8.4. Events outside our control (e.g., platform outages, severe weather) may cause delays. We are not liable for such delays where we act with reasonable care; your statutory rights remain unaffected.

9. Revisions & Scope Changes

9.1. Each order includes a specified number of revisions/iterations (as stated in your quote).

9.2. Material changes (e.g. new layout, added areas, changed priorities, new constraints or if your inputs were incomplete) may require a new quote, timeline, and fee.

9.3. Preference changes (e.g. your instructions, preferences, style or personal requirements change) may require a new quote, timeline, and fee.

10. Your Responsibilities

10.1. Provide accurate site information: site plans/surveys, address, measurements, photos/videos, HOA or city rules, easements/utilities/drainage notes, style preferences, and known constraints.

10.2. Obtain required permits/approvals and engage licensed professionals if and when needed.

10.3. Safety & compliance warning: DO NOT BUILD SOLELY FROM OUR DRAWINGS. Use qualified contractors and comply with all local laws/codes.

11. No Professional Advice

11.1. Our Services and deliverables support information and visualization only.

11.2. WE DO NOT PROVIDE ENGINEERING, ARCHITECTURAL, IRRIGATION, SURVEYING, LEGAL, OR DIRECT PERMITTING SERVICES unless explicitly stated in a signed order.

11.3. Where and if required, please arrange licensed professional review/stamps locally. After such review, our drawings can be submitted for permitting/approval. We do not guarantee permit/HOA approval.

12. Deliverables & Intellectual Property

12.1. Default drawing formats: PDF. On request (if included in your order), we may supply DWG, Land F/X DWG, or VIP3D exports alongside PDFs.

12.2. Ownership until paid. All designs and drawings remain the property of Seas of Green until full payment is received.

12.3. Deliverables may embed our or third-party intellectual property (e.g., proprietary symbols, blocks, templates).

12.4. Editable source files can be supplied if needed (on request); we may remove or substitute proprietary elements.

12.5. Your own project materials that you provide, or content developed specifically for you and paid for in full, are yours.

12.6. Third-party intellectual property and materials remain subject to their own rights.

13. Confidentiality

13.1. We treat your project data and communications as confidential and use them only to deliver Services, comply with law, and improve security/quality.

13.2. We never sell, rent, or trade your personal or project information to third parties. See our Privacy & Data Use notice for details.

14. Marketing Use

14.1. Unless you opt out, you permit us to use redacted (censored) project materials (partial plans, before/after images) in our portfolio and marketing.

14.2. We remove identifiers such as names, HOA account numbers, street numbers, lot/parcel numbers, full addresses, personal contact details, and billing information.

14.3. For any identifiable use (e.g., your name or full address), we will ask first.

14.4. Contact us to opt out of marketing use at any time.

15. Cancellations, Withdrawals & Refunds

15.1. Cancel before we start for a full refund. If work has begun, we refund pro-rata for unperformed work.

15.3. How to cancel. Contact us with your name and order number. Refunds go to the original payment method where possible, without undue delay.

16. Service Availability & Third-Party Services

16.1. Services are provided "AS IS" and "AS AVAILABLE," with reasonable skill and care consistent with law.

16.2. We use third-party platforms (e.g., Stripe, cloud hosting, file-transfer). Their terms and privacy notices apply.

16.3. To the extent permitted by law, we are not responsible for third-party outages or actions where we exercised reasonable care in selection and use.

17. Warranties & Liability

22. Good Faith

22.1. We and you agree to work together fairly and in good faith, acting with honesty, transparency, and professionalism, and to take reasonable steps to carry out the intent and spirit of these Terms.

23. Miscellaneous

23.1. Force Majeure. Neither party is liable for delay or failure caused by events beyond reasonable control (e.g., natural disasters, outages, war, strikes), except for payment obligations already due.
